Terms of Service

Welcome to India Grocery Basket (“IGB”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of our website and related services (collectively, the “Service”). By accessing or using the Service, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Service.
1. About the Service
IGB is an online grocery platform that lets you browse fresh Indian groceries, build a cart, pay through our checkout, and select a pickup slot at checkout. We coordinate ordering, payment, and fulfillment. We are responsible for the products we make available through the Service.
2. Eligibility and Accounts
You must be 18 years of age or older and able to form a binding contract in your jurisdiction to use the Service. When you create an account, you agree to provide accurate, current information and to keep it up to date. You are responsible for all activity under your account and for keeping your sign-in credentials secure. Contact us at indiagrocerybasket@gmail.com if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent or abusive.
3. Orders, Pricing, and Payment
3.1 Placing an Order
When you place an order, you make an offer to purchase the items in your cart at the prices shown, plus any applicable fees displayed at checkout. We may accept, decline, or cancel an order — for example, due to availability, pricing errors, or fraud prevention. Order acceptance occurs when payment is successfully processed and we send you an order confirmation.
3.2 Pricing and Fees
Before you pay, we display an itemized breakdown in your cart:
- Subtotal — the products in your cart
- Processing fee — a separate line covering payment-network costs
- Total — the final amount charged at checkout
Payments are processed by Stripe. We do not store full payment card numbers on our servers. Prices are shown in U.S. dollars.
3.3 Pricing Errors
We strive to display accurate prices and product information. If we discover a material error, we may cancel the affected order and issue a refund, or contact you for instructions.
4. Pickup and Fulfillment
4.1 Pickup Only
IGB currently offers curbside pickup only. Pickup is available at the locations listed in the Service (currently Milpitas and Union City, California). We do not offer delivery at this time.
4.2 Scheduled Pickup Windows
You will select a pickup date, location, and time window at checkout. Windows are estimates and may shift due to operational factors. You are responsible for collecting your order during the selected window.
4.3 Partial Fulfillment
If an item in your order is unavailable or cannot be supplied as ordered, we will fulfill the remaining items and refund the product subtotal for any unfulfilled line items to your original payment method. Refund timing is typically 5–10 business days after we initiate the refund, depending on your bank.
Processing fees are not refunded on partial fulfillment (see Section 5.3).
4.4 Order Cancellations by IGB
We may cancel an order before pickup if items become unavailable or for operational reasons. If we cancel after you have been charged, we will refund eligible product subtotals. Non-refundable fees still apply (Section 5.3). You may request cancellation before fulfillment begins by contacting us — we will try to accommodate but cannot guarantee cancellation once preparation has started, especially for specialty or made-to-order items.
5. Returns and Refunds
5.1 All Sales Are Final
We do not offer returns, exchanges, or refunds for change of mind or items received in accordance with your order, except as stated in these Terms.
5.2 When Refunds Apply
You may receive a refund of eligible product subtotals when:
- a product line item is not fulfilled (including partial fulfillment),
- we cancel a standard (non-specialty) product line before you receive it,
- a duplicate charge or payment error occurred, or
- we are required by law to provide a remedy.
5.3 Non-Refundable Fees
The processing fee collected at checkout is never refunded, including when an order is canceled or partially fulfilled, because the cost is incurred at the time of payment. Only product subtotals for items not fulfilled are eligible for refund, unless required by law.
5.4 Specialty and Made-to-Order Products
Some products are prepared or sourced specifically after you order. These are identified on the product page. Specialty and made-to-order products are not refundable once an order is placed, except where required by law.
5.5 Problems with Received Items
If you believe an item you received is incorrect, damaged, or unsafe, contact us promptly at indiagrocerybasket@gmail.com with your order number and details (photos are helpful). We will review the issue and may offer a discretionary remedy at our sole judgment.
6. Product Information and Food Safety
Product descriptions, images, ingredients, and allergen information are provided in good faith but may not always be complete or current. We do not guarantee that product information is suitable for your specific dietary needs. If you have allergies or dietary restrictions, please verify labels and ingredients before consuming. Consumption of food products is at your own risk.
7. Prohibited Conduct
You agree not to:
- violate any applicable law or third-party rights,
- provide false or misleading account or order information,
- interfere with the security or operation of the Service,
- scrape, reverse engineer, or misuse the Service except as permitted by law, or
- place orders for resale or abuse promotions or refunds.
8. Intellectual Property
The Service, including its design, branding, software, and content, is owned by IGB and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service for personal, non-commercial shopping in accordance with these Terms.
9. Disclaimers
The service and all products are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
10. Limitation of Liability
To the maximum extent permitted by law, IGB will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data. Our total liability for any claim arising out of or relating to the service or an order is limited to the greater of (a) the amount you paid for the order giving rise to the claim in the twelve months before the event or (b) one hundred U.S. dollars (US $100).
11. Governing Law and Disputes
These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules. Before filing a claim, please contact us and allow 30 days to try to resolve the dispute informally.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
